01 Who We Are

Valley Cash Buyer is an Arizona based real estate company that buys residential property directly from owners, typically for cash and on an as-is basis. We may purchase property for our own portfolio, assign or resell purchase contracts to other buyers, or otherwise act as a principal in real estate transactions.

Some of our owners and representatives are licensed real estate agents or brokers in Arizona. When you contact us, we may give you the option to meet with or be referred to a licensed real estate agent to review all of your options, including listing your property for sale on the open market, so you can choose the path that is best for you.

Unless you and a licensed agent sign a separate written representation agreement, we are not acting as your real estate broker or agent in connection with a sale of your property to Valley Cash Buyer, and we are not providing you with legal, tax, financial, or investment advice. For professional advice about selling your property, you should consult a licensed real estate agent, attorney, accountant, or financial advisor of your own choosing.

02 No Offer or Obligation

Submitting your information through the Site is a request for us to evaluate your property. It does not create a contract, and it does not obligate you to sell or obligate us to buy. Any offer we may extend is non-binding until set out in a written purchase agreement signed by both you and Valley Cash Buyer. Property values, offer amounts, and timelines described anywhere on the Site are general examples and are not promises of any specific price or result.

03 Eligibility

You must be at least 18 years old and a resident of the United States to use the Site. By using the Site, you represent that you meet these requirements and that the information you provide is accurate and that you are the property owner or are authorized to act on the owner's behalf.

04 Communications Consent

When you submit your contact information through the Site, you agree to be contacted by Valley Cash Buyer as described in the consent language presented on our forms and in our Privacy Policy. This may include phone calls, text messages (SMS/MMS), and emails, including through automated technology, sent to the phone number and email address you provide.

Your consent to receive marketing communications is not a condition of selling your property to us or of receiving an offer. You can opt out of text messages at any time by replying STOP, and you can opt out of marketing emails using the unsubscribe link in those emails. Message and data rates may apply, and message frequency varies.

05 Acceptable Use

You agree to use the Site only for lawful purposes. You will not:

• Submit false, misleading, or fraudulent information;
• Use the Site in any way that could damage, disable, or impair it, or interfere with anyone else's use of it;
• Attempt to gain unauthorized access to the Site or any related systems or data;
• Use any automated means to scrape, copy, or harvest content or data from the Site.

06 Intellectual Property

The Site and its content, including text, graphics, logos, the Valley Cash Buyer name and brand, layout, and software, are owned by or licensed to Valley Cash Buyer and are protected by intellectual property laws. We grant you a limited, personal, non-transferable license to view the Site for the purpose of evaluating our services. You may not copy, reproduce, republish, or redistribute any part of the Site without our written permission.

07 Third-Party Links and Services

The Site may link to or rely on third-party websites and services (for example, mapping tools, analytics, or customer-management software). We do not control those third parties and are not responsible for their content, accuracy, or privacy practices. Your use of any third-party site or service is at your own risk and subject to that third party's terms.

08 Disclaimer of Warranties

THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. 09 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VALLEY CASH BUYER AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10 Indemnification

You agree to defend, indemnify, and hold harmless Valley Cash Buyer and its owners, members, officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

11 Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the jurisdiction of those courts.

12 Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above. Your continued use of the Site after changes are posted means you accept the updated Terms.
